Legal visitation rights of grandparents

Often, minor children share a special relationship with their grandparents. But during the time of divorce or death of a parent, the grandparents suddenly lose the right to visit or care for their grandchildren. Such complex problems associated with deep feelings and emotions are quite common in the United States. All 50 states in the U.S. have different statutes and laws that permit grandparents to their grandchildren visit.

Because of increased divorce and children's shelterdrug abuse, the role of grandparents as caregivers of their grandchildren, even more prominence. Many grandparents are the responsibility of child care, especially in the case of working parents. A decision was taken by the U.S. Supreme Court in 2000, to grandparents to children that parents have considerable authority, but decisions regarding the child, they can not be confined to visiting the grandparents. Particularly in the context of the visitRights Enforcement Act, signed in 1998, may, grandparents have a right to visit their grandchildren, regardless of the domicile of the child.

But the most important factor that the court considers is before granting this right, whether the visit would be the grandparents of advantage to the child or not.
